An appeal will have your case elevated to a hearing presided over by an administrative law judge. The judge will question you and any witnesses you choose to bring, allowing you to tell your side of the story. The help of a GENEX representative substantially increases the odds of a favorable decision at the hearing level. Should you be denied a third time there are additional levels your case can be appealed and your representative can guide you through this process.
If your appeal is denied GENEX will work with you to file a Request for a Hearing within 60 days. After filing the Hearing Request your case will be assigned to an Administrative Law Judge and a hearing will be scheduled. GENEX will gather and submit evidence and prepare your for the hearing. GENEX's trained Representatives will attend the hearing with you and advocate on your behalf to the Judge. After the hearing the ALJ will make a decision based on the testimony and the submitted evidence. You will receive written notification as to the decision. If your case is still not awarded, an appeal to Federal court is the next level of available legal action. This is pursued by less than 1 percent of all claimants.
