After you have been notified of the result of your case, if it has been denied then you are given the chance to request reconsideration. If you are denied this second time, you will be able to appeal your case to be heard an Administrative Law Judge (ALJ). Around 15 percent of people who request reconsideration are found to be disabled at this level. It is probable that this will yield the same decision as the initial determination, because a different team working under the very same state agency using the same criteria will evaluate your claim that second time.
Should the initial disability applicon be denied, you have 60 days to ask for a first appeal (reconsideration). Again, GENEX Disability will work with you to provide requested information that and it will be reviewed by Disability Determination Services. You will then be notified in writing by the SSA of the decision. Some states, such as Pennsylvania do not have a Reconsideration. In these “pilot states” individuals file a Request for a Hearing after their initial denial.
