There are four major steps of the SSDI process. Click on the links below to learn more about them.
After filling out your paperwork, you will be scheduled to make an initial assessment with a GENEX representative, who will actually help you apply for Social Security disability with you by asking you questions about your disability, medicines, and physicians over the phone. You will be mailed a copy of your application to confirm that the information is correct, to be signed and sent to your local Social Security Administration (SSA) office.
If your case has been denied then you are given the chance to request reconsideration. If you are denied this second time, you will be able to appeal your case to be heard an Administrative Law Judge (ALJ). A GENEX representative can help you through these decisions.
An appeal will have your case elevated to a hearing presided over by an administrative law judge. The judge will question you and any witnesses you choose to bring, allowing you to tell your side of the story. The help of a GENEX representative substantially increases the odds of a favorable decision at the hearing level. Should you be denied a third time there are additional levels your case can be appealed and your representative can guide you through this process.
If you receive a denial at the Administrative Law Judge (ALJ) level, you can appeal, and the Appeals Council (AC) will review the decision to determine whether or not the denial was made in error. The AC may send your claim back to the ALJ for an additional hearing, or your claim may be further denied. If the claim is denied, the case goes next to Federal Court.
If your claim is awarded, GENEX will work with you to tie up loose ends and let you know when you should expect to receive payment, including retroactive payments. It is important to note that how much you receive is determined by a formula that considers your former earnings subjected to FICA taxes.
